This Privacy Notice (the Notice) has been issued in accordance with applicable Mexican laws, in compliance with the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, the Privacy Notice Guidelines, and the Federal Consumer Protection Law. As the data owner, you may request at any time a digital version of these provisions through Human Resources, via email at recruitment@vmsenergyinc.com.
This Notice describes the types of data that may be collected from VMS Energy Inc. clients and suppliers, how such data will be processed, and the individuals, companies, and authorities with whom such data may be shared.
Likewise, this Notice outlines the measures VMS Energy Inc. will adopt to protect and manage your personal data. The security of your information is our primary objective; therefore, we safeguard it through the use and maintenance of high-security measures.
Accordingly, in compliance with our Privacy Program and applicable regulations, your personal data will be handled confidentially, through systems and schemes designed for these purposes.

VMS Energy Inc. is a company organized under Mexican law and is responsible for VMS Energy Inc. your personal data through Human Resources, located at 7800 W Interstate 10 San Antonio Texas 78230.

VMS Energt Inc. may collect the following personal data from you:
3.1 From VMS Energy Inc. Clients
VMS Energy Inc. may collect identification and contact data from clients, including: business name, Federal Taxpayers Registry (RFC), tax address (street, exterior and interior number, neighborhood, postal code, city/municipality, state), and business activity or commercial sector.
Additionally, operational and financial contact information may be collected, such as institutional email addresses for sales and billing departments, phone numbers of contacts, names of persons responsible in accounts payable and other departments, as well as data necessary for registration in internal systems. Regarding banking information, we request bank name, account number, branch number, or Standardized Bank Key (CLABE).
Finally, graphic materials such as photographs of client assets and facilities may be requested, particularly when it is necessary to verify operational capacity or physical location for contractual or compliance purposes.
3.2 From VMS Energy Inc. Suppliers
Information may be collected from suppliers, including legal, fiscal, commercial, and banking data: business name, date and place of incorporation, full name of legal representative with powers for administrative acts, legal representation, and contractual obligations, as well as names of sole administrator and shareholders. Also requested are RFC, complete tax address, and company’s economic activity.
Regarding banking data, bank name, account number, branch number, 18-digit CLABE, and bank statement cover may be required to verify ownership and match tax data. Contact information is also collected, including institutional email and phone numbers, and if applicable, registration with the Public Registry of Specialized Contractors (REPSE).
Additional information may include prior experience, number of contracts, market seniority, and list of previous clients for technical validation or selection criteria. Positive compliance opinions from the Tax Administration Service and specific tax certificates may also be collected as necessary.
4. Purpose of Processing Personal Data
4.1 Regarding VMS Energy Inc. Clients
Data collected from clients is primarily used to establish formal business relationships, generate quotes, manage administrative files, and formalize service or sales contracts. Specifically, data is used to verify that the client is a legally registered entity with the Tax Administration Service and to validate tax address, business activity, and current tax status through tax certificates and compliance opinions.
Institutional contact data such as emails and phone numbers are used for efficient communication, tracking proposals, and ensuring proper payment processing. Banking information is requested to identify the paying institution and account.
All this information is necessary for proper client integration in internal management systems, creation of purchase or sales orders, electronic invoice generation, and coordination of deliveries or services. It also ensures that client data is complete and updated, allowing a transparent and legally compliant business relationship.
4.2 Regarding VMS Energy Inc. Suppliers
Data from suppliers is used to verify legal existence, commercial background, operational capacity, and authenticity of corporate, fiscal, and banking documentation. It confirms company seniority, prequalifies suppliers based on experience, matches business names with quotations, validates office locations, and identifies authorized personnel for contracts or purchase orders.
Supplier data also ensures compliance with tax, social security, and housing obligations through analysis of tax compliance opinions, INFONAVIT and IMSS certificates, and REPSE registration verification. Banking information validates payments, and contact information facilitates administrative, contractual, logistical, and compliance communications. All collected data supports formalization of service or sales contracts and documentation required for facility access or contracted service execution.
5. Data Sharing
Personal and corporate data collected from clients and suppliers may be shared nationally and internationally only when strictly necessary for the purposes described in this notice and always observing principles of confidentiality, legality, proportionality, and purpose.
Information may be shared with:
- Relevant fiscal and administrative authorities such as SAT, IMSS, INFONAVIT, STPS, and other government agencies, when legally required or necessary to demonstrate compliance.
 - External auditors, legal, fiscal, or accounting advisors, under confidentiality agreements.
 - Clients or final contractors when necessary to validate supplier or client identity and compliance.
 - Subsidiaries, affiliates, or group entities sharing administrative, accounting, operational, or compliance processes.
 - Banking institutions for account validation, payment processing, or reconciliation.
 - Technology, administrative, or document management service providers with access necessary for storage, backup, database management, invoicing platforms, or other internal system support.

Since images identifying individuals are personal data, VMS Energy Inc. informs you that its facilities contain real-time recording cameras for purposes including:
